What Can I Do If I'm in a VA or Norfolk Car Accident While On the Job?

After suffering serious injuries in a Virginia crash such as a Norfolk, Eastern Shore, Newport News, Hampton, or Virginia Beach car accident, the last thing on your mind may be filing a legal claim for compensation.  When medical bills and other expenses arise, however, you may be asking yourself how to receive help paying for these costs so you can focus on healing.  In some instances, Virginia truck accident or car wreck victims don't realize that a legal claim is possible, especially when they have been injured in accidents that occurred in the context of work.

Virginia workers' compensation is different from personal injury claims in that it is "no-fault," meaning you may be able to file a legal claim even if no one was responsible for your accident, as long as it occurred while on the job.  Since workers' comp. works this way, it does not compensate for "pain and suffering," like other Virginia accident claims.  That being said, there are a couple important facts to highlight regarding work-related vehicle accidents in Norfolk, Virginia Beach, and other parts of the state:
  • you may be able to file a Virginia workers' comp. claim as long as your injuries occurred within the context of work
  • workers' comp. claims from vehicle accidents may result from the following types of collisions:  a wreck in a company vehicle, a wreck in one's own vehicle while performing work-related tasks, a wreck in another type of vehicle while traveling on company time (depending on the circumstances)
  • in some cases, accident victims may be able to file a workers' comp. claim and an auto accident claim, as long as another party was at-fault and directly responsible for the the injuries of the victim (in order to constitute an auto accident claim).
