$1.6 Million - Pedestrian Hit by Truck

My client suffered a mild traumatic brain injury when he was struck by a company truck while walking to school.  The driver of the truck said that he never saw the young man because he had not cleaned his windshield and the sun was in his eyes. This case was settled in mediation where all the parties agreed on this amount, without going to trial.

A couple of unique factors contributed to the award amount in this case, primarily (and most importantly) the severity of the injury suffered by the pedestrian, as well as the amount of insurance coverage available from the trucking company's insurers.  Although a traumatic brain injury may be termed "mild," any injury to the brain is exactly that:  an injury to the brain, not just the head.  As a result, the consequences of brain injuires may affect daily life, whether in the form of periodic seizures that interfere with normal activities or in even more catastrophic ways.  Accidents in which a large truck strikes a pedestrian, as in this case, tend to cause more severe damage.

Another factor affecting a decision in a brain injury case is the amount of insurance coverage available for the brain injury victim to recover.  Since many truck driver and trucking company insurance carriers have higher policy limits for bodily injury claims, the maximum amount of compensation available for injured accident victims is much higher than that of a crash between two sedans or smaller vehicles.  It is important to understand that policy limits refer to the maximum amount of insurance coverage available per person and per truck accident, rather than indicating the actual amount a person or family will receive in a case.
