I received one of the most disturbing and upsetting calls I have ever received in my entire legal career. The father of a young child had sustained fourth degree burns as a result of a “freak accident”. The father called practically crying while describing exactly what had happened to his six-year-old daughter.
His daughter was at her grandmother’s home on a hot summer afternoon. The grandmother who loves her granddaughter very much thought that the long jeans she was wearing were over heating her and told her she would like to make the long jeans into short jeans. The six-year-old child went along with her grandmother’s suggestion. She took the jeans off. Her grandmother cut the jeans. The young girl put the jeans back on. Her grandmother noticed there were some frilled edges at the bottom of the newly cut jeans. Unfortunately, without thinking it through the grandmother used a lighter to singe the fringes, at which point the jeans exploded on her. This caused fourth degree burns as well as horrible trauma, which one could never understand unless they went through this situation personally.
Fortunately, there was a significant amount of homeowners insurance, which eventually paid the claim. When I was negotiating the claim, the adjuster attempted to play down the permanent scarring. WI reminded the adjuster that on 9/11 when the World Trade Centers were burning people jumped out of the window to prevent being burned. I told the adjuster that the only thing this young six-year-old girl could do was jump up and down. She could not get away from the flames emanating from her highly flammable jeans, which remained on her as she attempted to “run away” from the burning pain to no avail. I now have seven-year-old twin girls. As I tell this story it remains very emotional for me personally. I am very satisfied that we were able to obtain a full settlement for her case without the necessity of putting her through trial.
I am equally happy that we knew where to find a lot of insurance to fully compensate her for the horrific injuries she sustained. It looks like my 35 years of personal injury experienced paid off.
All of us are careless in life at one time or another. Most people do not know that homeowners insurance covers the careless acts of the homeowners on and off the property.
