What is Each Moment of Life Worth?

I recently represented an 80-year-old gentleman who lost his wife following a horrific accident.  They were both involved in the collision, but his wife passed away twelve days later.

My client’s wife had Alzheimer’s disease for ten years prior to the crash. A year before the accident, she had been given between six to twelve months to live, which brought up some end-of-life issues.

The defense took the position that she was going to die anyway.  They looked at her three sons and basically took the approach, “Come on, get over it. We all have to die sometime. She lived past her expectancy.”

I have never done this before, but in my closing, I said, “Counsel’s words are truly an affront to her memory and an affront to the family, when they speak like that. Judge, if I may, I would like to speak as if I were the fourth son...we knew Mom was going to die, but it was precisely that reason why we knew every moment was so special.  God is not the one who decided to take her life - this was done by the negligent defendant.  This negligent defendant took that decision away from God.”  I went on to ask the judge, what is the value of every moment of life?  What was it worth to this woman? 

Even the judge had a tear in his eye during the trial.

We had $800 in medical bills and were awarded $62,500 in damages.  We had initially been offered $10,000.  Other attorneys had advised me to take the offer, but I told them that they hadn’t met my client.  According to his wife’s doctors, she lived as long as she did because her husband was the ultimate caregiver.
