Date set for Eastville jail's negligent death lawsuit

A trial date has been set for Oct. 17 in a federal lawsuit filed by the husband of a 38-year-old woman who died of a heart attack while incarcerated in Eastern Shore Regional Jail after allegedly pleading for medical help.

The complaint seeks damages of $10 million in the 2008 death of Cape Charles resident Christina D. Baumann, who began her incarceration Feb. 25, 2008, and died June 13, less than four months later.

Chesapeake attorney Thomas B. Kelly, who was hired by Baumann's husband, said the lawsuit is based primarily on "the failure to appropriately respond to her symptoms that she manifested during the week prior to discovering her unresponsive on the floor of her cell."
