In a hearing this month, a Georgia nursing home operator was ordered to pay $43.5 million in connection with the wrongful death of one of his nursing home residents, according to the Atanta Journal-Constitution. The family of then 80-year-old Morris Ellison claims that his April 2007 death resulted from negligence of the nursing facility, which had already been cited for a number of federal and state violations before his death. Ellison's daughter, Loretta Terhune, filed the wrongful death complaint in March 2009, which alleges that the facility failed to provide adequate care for the resident. Ellison was in the facility for about one year and suffered from numerous falls, including one that resulted in a broken hip. According to the lawsuit, the nursing home never notified Ellison's family or physicians when he sustained injuries. One of Terhune's attorneys explains that the nursing home resident was "severely neglected," dehydrated, and malnourished at the time of his death. The attorney claims that nursing home operator George D. Houser drained resources and money from the nursing home (and his other facilities), causing shortages of basic supplies, medicine, water, and food. In addition to this case, Houser faces federal charges for allegedly spending more than $30 million of Medicaid and Medicare funding on real estate and luxury vehicles rather than on care for nursing home residents.
